Kelly McGuirk again charged with stealing from Safeway
May 22, 2025 — On May 19, 2025, Kelly McGuirk was charged, again, with three counts of stealing from Safeway in Foster City, a newly-filed criminal complaint alleges.
The complaint states that Kelly McGuirk stole from Safeway "on or between April 19, 2025 and April 26, 2025," and the theft(s) totaled more than $950. It appears that the District Attorney is alleging McGuirk stole on more than one of those dates.
According to public records, some of which have since been expunged* (removed from public view) by petition of Kelly McGuirk, this is McGuirk's fifth case of being charged with stealing from Safeway. McGuirk's first conviction of stealing from Safeway was 30 years ago — in 1995 — with subsequent convictions in 1996, 1997, and 2008.
With the passage of Proposition 36 in California's November 2024 election, the punishment for conviction of Penal Code 666 is up to 3 years in prison and up to a $10,000 fine.

Criminal Complaint
An arraignment in this case is currently scheduled for June 17, 2025, while McGuirk's previous case in 2024 of theft from Macy*s also has a hearing set on July 9, 2025.
